The High Court of Justice Planning Court has upheld the Lake District National Park Authority’s decision in respect of planning application 7/2023/5767 Elterwater Quarry, Great Langdale, Ambleside, Cumbria.
The ruling was made following legal action by Friends of the Lake District to review the initial decision made at LDNPA’s Development Control Committee in May 2024.
The Authority adheres to a robust set of policies when assessing planning applications, which ensure protection of the spectacular landscape, enhancing vibrant and resilient communities and enabling world class tourism.
In his ruling, the Honourable Mr Justice Mould agreed that LDNPA acted lawfully, accurately and fairly assessing the application during its Development Control Committee meeting in respect of the Elterwater Quarry application and dismissed all grounds of Friends of the Lake District’s claim. In addition, he agreed with the LDNPA’s interpretation and application of the Sandford Principle.
Steve Ratcliffe, Director of Sustainable Development at the Lake District National Park Authority, said:
“Whilst we are pleased with the result and respect the right of any person or organisation to challenge the decisions made by the LDNPA through judicial review proceedings, we are disappointed that the application came before the High Court without any engagement with pre-action protocols or notification, resulting in significant costs for both the Authority and Friends of the Lake District.”
